Welcome to StudyAnything (the “Service”), a software-as-a-service (SaaS) application provided by StudyAnything Pty Ltd (“we,” “us,” or “our”). The Service allows users to upload study materials, including but not limited to PDF documents to generate AI-powered practice questions based on the uploaded content. By accessing or using the Service, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, do not access or use the Service.

1. Eligibility

To use the Service, you must be at least 18 years old and legally capable of entering into binding contracts. If you are using the Service on behalf of an organization, you represent and warrant that you are authorized to accept these Terms on that organization’s behalf.

2. Use of the Service

You may use the Service solely for lawful purposes and in accordance with these Terms. You are responsible for any content you upload, including PDFs, and for ensuring that you have all necessary rights and permissions to use and share that content.

3. AI-Generated Content Disclaimer

The Service uses generative artificial intelligence to create quiz questions based on the documents you provide. While we strive for accuracy and quality, we make no representations or warranties regarding the correctness, reliability, appropriateness, or usefulness of any AI-generated content.

• Generated content may be incorrect, misleading, incomplete, or inappropriate.
• You use all generated content at your own discretion and risk.
• You are solely responsible for reviewing, verifying, and evaluating the suitability of any content produced by the Service.

• (a) as to the availability of any product, good, service, process or technology described on the Platform;
• (b) that the functions contained in the Service or your access to the Service will be error-free;
• (c) that any defects on the Service or the Materials will be corrected;
• (d) that any information, apparatus, product, software or process used or disclosed on the Service or any Material accessible from the Service will be accurate, up to date, complete or useful; or
• (e) that the Service or the server which stores and transmits the Material to you are free from viruses or any other harmful components.

7.2. To the fullest extent permitted by law, StudyAnything, its officers, employees, agents and contractors (StudyAnything’s Group) disclaims all warranties of any kind (whether express or implied) in relation to the Service and the Material and will not be liable for any direct or indirect damage (including special and/or consequential damage, such as loss of business, loss of profits or loss of data) which results from any use or access of, or any inability to use or access the Service or the Material even if StudyAnything or any other member of StudyAnything’s Group was made aware of the possibility of such damages.

7.3. Without limitation to the foregoing, StudyAnything’s Group acknowledges that the laws in certain jurisdictions including Australia may imply warranties and conditions or impose obligations on the supply of goods and services through or by means of the Service which cannot be excluded, restricted or modified except to a limited extent. If any such laws apply, then to the fullest extent permitted by the law of the relevant jurisdiction and in the case of Australia to the extent permitted by The Australian Consumer Law in the Competition and Consumer Act 2010 (Cth), StudyAnything’s Group limits its liability and if any liability remains it will be limited to any one or more of the following in its sole discretion:

• (a) in the case of any goods, the replacement or repair of the goods, or the supply of equivalent goods, or the payment of the cost of repairing or replacing the goods or supplying equivalent goods; and
• (b) in the case of any services, the supply of the services again or the payment of the cost of having the services supplied again.

8. You indemnify StudyAnything’s Group from and against all Claims, Losses, actions, liabilities, costs and expenses (including legal costs on a full indemnity basis) resulting from your failure to comply with these Terms.

We reserve the right to update or modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website or within the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

10. Pricing Tiers and Access

The Service may be offered under multiple pricing tiers or subscription plans, each with varying levels of features, access limits, and usage allowances (“Plans”).

We reserve the right, at our sole discretion, to:

• Determine the features and limitations of each Plan;
• Modify, discontinue, or introduce new Plans at any time;
• Change pricing, billing cycles, or access entitlements for any Plan;
• Offer promotional pricing or discounts which may not be available to all users or Plan types.

Your access to specific features of the Service depends on the Plan you have subscribed to. It is your responsibility to review the Plan details and ensure it meets your requirements before subscribing.

All fees are non-refundable unless otherwise stated. We may suspend or limit your access to the Service if your payment method fails, your Plan expires, or your usage exceeds the limits of your subscribed Plan.
